Agreement to Terms

By accessing and using the Kaqi mobile application ("App"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

Description of Service

Kaqi is a yoga and mindfulness application that provides:

• Access to various yoga courses and instructional content
• AI-powered yoga instructor chat services
• Practice tracking and progress monitoring features
• Content bookmarking and organization tools
• Daily inspiration and motivational content

User Accounts

You are responsible for maintaining the confidentiality of any account information and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

Acceptable Use

You agree not to use the App:

• In any way that violates any applicable federal, state, local, or international law or regulation
• To transmit, or procure the sending of, any advertising or promotional material without our prior written consent
• To impersonate or attempt to impersonate the company, a company employee, another user, or any other person or entity
• In any manner that could disable, overburden, damage, or impair the App or interfere with any other party's use of the App
• To engage in any other conduct that restricts or inhibits anyone's use or enjoyment of the App

Intellectual Property Rights

The App and its original content, features, and functionality are and will remain the exclusive property of Kaqi and its licensors. The App is protected by copyright, trademark, and other laws. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

User Content

You retain all rights to any content you submit, post, or display on or through the App ("User Content"). By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, and display such User Content solely for the purpose of providing and improving our services.

AI Services

The AI instructor features are provided for informational and guidance purposes only. The AI responses are generated automatically and should not be considered as professional medical, health, or therapeutic advice. Always consult with qualified healthcare professionals for medical or health-related concerns.

Health and Safety Disclaimer

Yoga and exercise activities involve physical exertion and may involve risk of injury. You acknowledge and agree that:

• You participate in any yoga practice or exercise at your own risk
• You should consult with a healthcare provider before beginning any new exercise program
• We are not responsible for any injuries that may occur during or as a result of using our App
• You should stop any exercise immediately if you experience pain or discomfort

Service Availability

We do not guarantee that the App will be available at all times. The App may be unavailable due to maintenance, updates, technical failures, or other circumstances beyond our control. We reserve the right to modify, suspend, or discontinue any part of the App at any time without notice.

Limitation of Liability

To the fullest extent permitted by applicable law, Kaqi and its affiliates, officers, employees, agents, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the App.

Indemnification

You agree to defend, indemnify, and hold harmless Kaqi and its affiliates, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with your access to or use of the App or your violation of these Terms.

Termination

We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the App will cease immediately.

Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to its conflict of law provisions.
